29 CFR 1910.27(c)(4): The distance from the centerline of rungs, cleats, or steps to the nearest permanent object in back of the ladder was less than 7 inches, except that when unavoidable obstructions are encountered, minimum clearances as shown in Figure D-3 shall be provided.     The employer does not ensure that rungs on fixed ladders are not less than 7 inches from the centerline of rungs and the nearest object in back of the ladder. This violation occurred on or about April 2, 2015 and time prior thereto, where employees were exposed to a 41 inch fall hazard when using a fixed ladder on the rear of the building with the rung being 3-3/4 inches from the brickwork.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the distance from the centerline of rungs, cleats, or steps to the nearest permanent object in back of the ladder is no less than 7 inches, except that when unavoidable obstructions are encountered, minimum clearances as shown in Figure D-3 shall be provided.
