29 CFR 1910.106(d)(5)(iii): The storage of flammable or combustible liquids required and used for the maintenance and operation of building and operation of equipment was not kept in closed metal containers stored in a storage cabinet or in safety cans or in an inside storage room not having a door that opens into that portion of the building used by the public:  (a)  Mechanic's Shop, Parts Room - On or about April 3, 2015 employees were exposed to the ignition of flammable aerosol paint products stored on an open 3-tiered metal shelving unit and elsewhere due to there being no approved storage cabinet for the following products:  multiple Krylon Rust Preventative 12 ounce aerosol cans; 17 ounce cans of IPC Light Gray Primer; cans of NAPA Disc Brake Quiet; cans of Krylon Farm & Implement Paint; cans of Krylon Rust Tough Rust Preventative Enamel; a gallon of Nason 491-17 ETCH Primer, cans of brake cleaner, penetrating oil, starting fluid, penetrating grease, etc.

Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either:  (i) The information specified under paragraphs (f)(1)(I) through (v) of this section for labels on shipped containers; or,  (ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  (a) South of Office Building - On or about April 3, 2015, employees were exposed to injury from spillage from the 12-14,000 gallon capacity above ground Diesel Fuel Storage Tank due to the absence of information about the tank's contents and appropriate hazard warning(s), e.g., "DIESEL" and "COMBUSTIBLE."
