29 CFR 1926.20(b)(2): The employer did not initiate and maintain safety programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):   (a) On or about April 7th, 2015, at a construction site located at 201 Westport Road in Kansas City, MO, an employee entered a confined space and became functionally impaired by vapors emitted from an adhesive sealant that he was applying.  The employer failed to initiate and maintain safety programs that provided frequent and regular inspections of the job site and of the materials that were sufficient to have identified the subject area as being a confined space, and to have detected the inappropriate use of the selected material within a confined space.   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
