OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(I) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of working in a confined space: On or about March 23, 2015, 3rd floor of feed mill building, employees were exposed to the hazard of fire, explosion, and deflagration, while engaged in work activities inside mash feed bin 84. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that appropriate confined space entry training has been done.

29 CFR 1926.353(b)(3): Lifelines. Where a welder must enter a confined space through a manhole or other small opening, means shall be provided for quickly removing him in case of emergency. When safety belts and lifelines are used for this purpose they shall be so attached to the welder's body that his body cannot be jammed in a small exit opening. An attendant with a pre-planned rescue procedure shall be stationed outside to observe the welder at all times and be capable of putting rescue operations into effect. (A) Means were not provided for quick removal as required and/or an attendant did not have a pre-planned rescue procedure, was not stationed outside, and was not capable of putting the rescue operation into effect as required. On or about March 23, 2015, feed mill 3rd floor, an attendant with preplanned rescue was not stationed outside of bin 84 at all times an employee used an oxygen-acetylene torch in mash feed bin 84 which exposes the employee to fire and oxygen hazards where feed (combustible dust) was present. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an appropriate observer equipped to provide assistance is stationed outside the bin during entry.
