29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. (As referenced in CFR 1926.103):  a) At the jobsite, on or about 4/14/15:  A worker was using an air hammer to abrade and remove the surface from several sections of concrete sidewalk and driveway without wearing a respirator, and without the employer having conducted an assessment to determine the need for respiratory protection where the likelihood of exposure to silica was likely.    Abatement certification must be submitted for this item.

29 CFR 1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge:  a) At the jobsite, on the roof, on or about 4/14/15:  Workers were performing roofing work on an irregularly shaped roof where a cable guardrail system was installed at the direction of the contractor, and where that cable system was incorrectly installed and not able to assure the 200 pound minimum force requirement.    Abatement certification must be submitted for this item.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used:  a) At the jobsite, on the roof, on or about 4/14/15:  Workers were performing roofing work on an irregularly shaped roof where a cable guardrail system was installed at the direction of the contractor, and where that cable system was incorrectly installed not able to assure the 200 pound minimum force requirement, nor were workers trained to recognize the faulty installation.    Abatement certification must be submitted for this item.
