29 CFR 1910.178(l)(1)(i):   The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l)  (Construction Reference 1926.602):  a)  117 Speedwell Avenue, Morristown, NJ and at the Corporate Offices at 56 Leonardine Avenue, South River, NJ.  The operator of the Xtreme rough terrain forklift had not received the training and evaluation required in the powered industrial truck regulation.                                              Violation observed on or about 04/11/2015.

29 CFR 1926.451(g)(4)(iv):  Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface:  a)  117 Speedwell Avenue, Tubular Welded Frame Scaffold on the East Side, Morristown, NJ.  Employee was exposed to falls of up to 13 to 14 feet to the ground below from the tubular welded frame scaffold as midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface.                                              Violation observed on or about 04/11/2015.

29 CFR 1926.452(c)(2): Tubular welded frame scaffold(s) were not properly braced by crossbracing or diagonal braces, or both, to secure vertical members laterally and to align them so that the erected scaffold was plumb, square, and rigid:  a)  117 Speedwell Avenue, Tubular Welded Frame Scaffold on the East Side, Morristown, NJ.  Employee was exposed to falls of up to 13 to 14 feet to the ground below from the tubular welded frame scaffold given a possible structural collapse of the scaffold as 8 crossbraces were not attached between vertical members at working levels.                                              Violation observed on or about 04/11/2015.
