29 CFR 1910.134(c)(1): The employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations:  (a) Discount Forklift Brokers, at 4625 Colorado Blvd, Denver, CO: On and preceding 04/21/15, the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations. Employees painted forklifts using spray paint. This process generated paint fumes and exposed employees to volatile organic compounds. The employer required the employees who worked in the fabrication room to wear 3M 7502 filtering facepiece respirators with 6001 organic vapor cartridges while painting forklifts. The employer had not established or maintained a written respiratory protection program.  This condition potentially exposed employees to a respiratory hazard.

29 CFR 1910.134(e)(1) The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) Discount Forklift Brokers, at 4625 Colorado Blvd, Denver, CO: The employer did not provide medical evaluations to determine each employee's ability to use a respirator, before the employee was fit tested or required to use a respirator in the workplace.  This condition may allow employees with pre-existing medical conditions to use respirators when they are not physically capable of doing so.
