29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section:     The front of the building under construction, southwest:  On or about April 21, 2015, and at times prior thereto, employees were exposed to a fall hazard greater than ten feet to the ground, while welding steel brackets to the beam from a makeshift scaffold platform that was elevated with a JLG Rough Terrain Forklift.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms that were not specifically designed by the manufacturer for such use:     The front of the building under construction, southwest:  On or about April 21, 2015, and at times prior thereto, employees were exposed to a fall hazard greater than ten feet to the ground, while welding steel brackets to the beam from a makeshift scaffold platform that was elevated with a JLG Rough Terrain Forklift.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:     The front of the building under construction, southwest:  On or about April 21, 2015, and at times prior thereto, employees were exposed to a fall hazard greater than ten feet to the ground, while welding steel brackets to the beam from a makeshift scaffold platform that was elevated with a JLG Rough Terrain Forklift.
