29 CFR 1926.1101(k)(3)(i): Before work subject to this standard in areas containing ACM and PACM was begun, the employer did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: 1) On or about April 10, 2015, and at prior times, World of Windows of Denver, LLC, as the controlling employer, did not ensure that its sub-contractor, Pirate Ind LLC, identified the presence, location, and quantity of ACM prior to engaging in work where asbestos containing material in drywall was disturbed and removed during window replacement.
