29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. At the work site located at 1858 Cedar Hill Road, employees operated CNC machinery that included (but was not limited to) Makino a51nx, Doosan Pumas, six Mazak Nexus, Mazak Nexus Vertical 1, six Mazak lathes, Makino Duo 63 EDM, two programmable Bridgeport drill presses and a Bridgeport lathe. The employer did not establish a program consisting of periodic inspections, employee training and/or energy control procedures during procedures that included (but were not limited to) changing out tools, removing jams, changing settings, checking clearances, calibrating and setting up for a new product run.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a. At the work site, employees operated a Mazak Nexus 250II #1 that would continue to operate if the door interlocks were opened. The employer had not ensured that the Mazak Nexus 250II #1 was adequately guarded at the point of operation. b. At the work site, employees operated a Mazak Nexus 250II #2 that would continue to operate if the door interlocks were opened. The employer had not ensured that the Mazak Nexus 250II #2 was adequately guarded at the point of operation. c. At the work site, a manual lathe that would operate with the chuck guard up, exposing the operator to the point of operation. The employer had not ensured that the manual lathe was adequately guarded at the point of operation. d. At the work site, Bridgeport drill press #1 did not have adequate guarding at the point of operation, exposing the operator to moving parts. The employer had not ensured that the Bridgeport drill press #1 was adequately guarded at the point of operation. e. At the work site, Bridgeport drill press #2 did not have adequate guarding at the point of operation, exposing the operator to moving parts.The employer had not ensured that the Bridgeport drill press #2 was adequately guarded at the point of operation.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. a. 29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and a. At the work site located at 1858 Cedar Hill Road, the employer allowed employees who were polishing certain parts prior to shipping and any employee who was welding to wear respiratory protection voluntarily. The employer had not provided employees with the information in Appendix D as required by the standard.
