29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: Note to paragraph (b)(2)(v) : As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering or in a restraint system is acceptable and is regulated under Sec. 1926.502(e). a) 222 Arsenal Rd, York PA - An employee was observed working from a Lift-All aerial bucket truck approximately 22 feet - 25 feet above ground and was not wearing a body belt (or harness) with lanyard attached to the boom or basked and was exposed to a fall hazard, on or about April 30, 2015. IN THE ALTERNATIVE 29 CFR 1910.67(c)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: a) 222 Arsenal Rd, York PA - An employee was observed working from a Lift-All aerial bucket truck approximately 22 feet - 25 feet above ground and was not wearing a body belt (or harness) with lanyard attached to the boom or basked and was exposed to a fall hazard, on or about April 30, 2015. No abatement certification or documentation required.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: a) 222 Arsenal Road, York PA - Employees working from a Lift-All aerial bucket truck were not trained in the recognition and avoidance of hazards associated with aerial lift usage, on or about April 30, 2015. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
