OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:  a)  On or about April 29, 2015 the employer did not ensure that employees working in and around loading docks were protected from struck-by and/or crushing hazards created from vehicular traffic.

29 CFR 1910.178(l)(3)(ii)(I): Powered industrial truck operators did not receive initial training in other unique or potentially hazardous conditions of the workplace that could affect safe operation:  a) On or about April 30, 2015 each employee authorized to operate forklifts in the warehouse, Plant 11, was not provided with training regarding safe operation for loading docks safety. The companys training and evaluation did not include dock safety techniques and procedures.
