29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not used wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:  Building No. 5:  On or about May 4, 2015, an employee was exposed to the hazard of being struck by flying projectiles, in that employees were using a pneumatic nail gun to install siding on the floor of a balcony without the use of safety glasses.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  Building No. 5:  On or about May 4, 2015, an employee was exposed to a fall hazard of greater than 6 feet to the ground below, while installing siding on the floor of a third floor balcony without having fall protection measures in place.  Jose Garcia Framing, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 999289, citation number 1, item number 1, and was affirmed as a final order on 11/13/2014, with respect to a workplace located at 10102 Ingram Rd., San Antonio, TX 78251.
