OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  A.) Joe Stubenhofer dba Stubenhofer Landscaping, 220 Peninsula Drive, Erie, PA  16505, on or about May 7, 2015 and times prior thereto:   Employees were potentially exposed to struck-by hazards from skid steers that were not equipped with back-up alarms and that were operated in reverse with obstructed rear views.  Employees were working near and around a Bobcat skid steer (M/N:  773, PIN:  509639527) performing landscaping duties.  Employees were exposed to a struck by hazard in that the skid steer was not equipped with a backup alarm, nor was a company policy in place for the use of backup spotters.

Joe Stubenhofer dba Stubenhofer Landscaping, 220 Peninsula Drive, Erie, PA  16505, on or about May 7, 2015 and times prior thereto:  Employees were using chemicals including, but not limited to, Lesco Professional Turf Fertilizer and FarmGro Plant Food.  The material safety data sheets for the Lesco Professional Turf Fertilizer and FarmGro Plant Food were not on-site.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:   A.) Joe Stubenhofer dba Stubenhofer Landscaping, 220 Peninsula Drive, Erie, PA  16505, on or about May 7, 2015 and times prior thereto: employees did not receive training on the new labeling elements (pictograms) and safety data sheet format by the December 1, 2013 deadline noted in the 29 CFR 1910.1200 (j)(1) of the Hazard Communication - 2012 Standard.  Employees were using chemicals including, but not limited to, Lesco Professional Turf Fertilizer and FarmGro Plant Food.
