29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a) Excavation, new townhome construction located at 9099 Tuckerbrook Lane, Johns Creek, GA 30022: The excavation was not inspected by the competent person on site prior to the start of work. No protective system was used inside a 9 ft. deep trench with type "b" soil.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   (a) Excavation, new townhome construction located at 9099 Tuckerbrook Lane, Johns Creek, GA 30022. Employees were exposed to soil cave-ins while working in an excavation which was 9-feet wide x 9-feet long x 9-feet deep installing/repairing a 6-inch PVC Sewer Line in a type "b" soil with no cave-in protection system in place.
