29 CFR 1910.22(b)(1): Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repairs, with no obstruction across or in aisles that could create a hazard.  Mattress assembly & South dock area - On or about May 5, 2015, employees use mechanical handling equipment including, but not limited to pallet jacks and hand trucks on a daily basis. Sections of the aisles and passageways contain broken and/or eroded concrete. Employees were thereby exposed to the hazards associated with aisles and passageways not kept in good repair.

29 CFR 1910.38(b): Written and oral emergency action plans. An emergency action plan must be in writing, kept in the workplace, and available to employees for review. However, an employer with 10 or fewer employees may communicate the plan orally to employees.  Throughout facility - On or about May 5, 2015, the employer had not developed and implemented an emergency action plan for employees working throughout the facility. Employees were thereby exposed to the hazards associated with fires and emergencies.
