29 CFR 1910.178(p)(1): Powered industrial truck(s) in need of repair, defective, or in any way unsafe was not taken out of service until it was restored to safe operating condition:         (a)  PIPO, Inc., 75 Ontario Street, Norwalk, Ohio:  On or about May 27, 2015, the employer did not ensure that the Komatsu Model FG25HT-14 fork truck was taken out of service when the parking brakes were not functioning correctly.  The fork truck was observed operating in close proximity to employees.  The fork truck would move when the parking brake was set.  Employees were exposed to struck-by hazards and were at risk of serious injury.
