OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being ejected from the seat of the John Deere equipment. (a) Dairy Farm: On or about May 27, 2015, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) of the powered industrial trucks, including but not limited to all John Deere equipment used for feeding and hay moving. Note: Abatement certification IS required for this item.
