29 CFR 1910.23(c)(1): Open-sided floors and/or platforms 4 feet or more above adjacent floor or ground level were not guarded with standard railings: In the following instances platforms at Expera Specialty Solutions were not provided with standard railings and personal protective equipment was not utilized: a) #2 Truck Dumper, East Platform - The top rail, for the eastern guardrail system, was not 42 inches high, and the fall distance to the ground exceeded 9 feet. b) #2 Truck Dumper, East Platform - The top rail, for the northern guardrail system, was not 42 inches high, and the fall distance into the chip hopper exceeded 4 feet. c) #2 Truck Dumper, West Platform - The top rail, for the western guardrail system, was not 42 inches high, and the fall distance to the ground exceeded 9 feet. d) #2 Truck Dumper, West Platform - A guardrail system was not provided on the northern end, and the fall distance into the chip hopper exceeded 4 feet.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment in a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to internal injuries, fractures and death due to falls from trailers: Expera Specialty Solutions - On 6/2/15 and times subsequent there to, employees netting and unnetting chip trailers were not protected from falling.
