29 CFR 1910.1001(j)(3)(i): The building owner, facility owner, or employer did not determine the presence, location, and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos containing material (PACM): a.) Building 23/Pinnacle Lease Area at 57 Harvester Avenue, Batavia, NY - On or about 6/5/15, 'Mancuso' leases approximately 60,000 SF of manufacturing space to Pinnacle. That building is greater than 100 years old, with some PACM insulated pipe traversing over portions of the manufacturing area. The building owner had not determined the presence, location and quantity of ACM or PACM at the worksite and did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of asbestos-containing material (ACM) and presumed asbestos containing material (PACM). ABATEMENT CERTIFICATION REQUIRED

Pinnacle leased area at 57 Harvester, Batavia NY - On or about 6/5/15, the building/facility owners did not inform employers (Pinnacle) of employees who will perform housekeeping activities in areas which contain ACM and/or PACM of the presence and location of asbestos-containing or presumed asbestos-containing materials (ACM/PACM) in Pinnacle's leased space where Pinnacle's employees perform housekeeping duties such as sweeping floors. ABATEMENT CERTIFICATION REQUIRED
