29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about June 05, 2015, and at times prior thereto, a platform installed on the Genie rough terrain forklift was used to elevate personnel to perform work on the building under construction. The forklift was not designed for such use per the manufacturer's operations manual, exposing employees to the hazard of falling approximately 30 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   On or about June 05, 2015, three employees were working from an elevated platform that was not securely attached to the lift to prevent the platform from sliding off. The platform was used with the Genie rough terrain forklift to access elevated positions on the building under construction, exposing employees to a fall hazard of approximately 30 feet.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  On or about June 05, 2015 and at times prior thereto, a rough terrain forklift was used to elevate personnel for steel construction work. The employer did not consult the manufacturer on the design of the platform and necessary changes to the forklift operational decals. Employees were exposed to the hazards of falls up to approximately 30 feet and/or scaffold collapse/failure.
