The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.      a)        Earthstone Products @ 2216 Airway Ave, Fort Collins CO 80524:  On or before June 3rd 2015, the employer did not ensure that blades on the cement mixer are fully guarded to prevent accidental contact at the point of operation.  This condition potentially exposed employees to struck-by, caught-in, and/or amputation hazards.

(a)        Earthstone Products @ 2216 Airway Ave, Fort Collins CO 80524:  On or before June 3rd 2015, the employer did not have a written Hazard Communication program to ensure that employees are notified of all potential chemical hazards.  This condition potentially exposed employees to chemical hazards associated with Portland Cement, Formaldehyde, and Isocyanate.  Safety Data Sheet (SDS) for Polytek 2-part polyurethane indicates this product contains Toluene Diisocyanate.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. If such hazards are present, or likely to be present, the employer shall select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment. (a)        Earthstone Products @ 2216 Airway Ave, Fort Collins CO 80524:  On or before June 3rd 2015, the employer did not provide medical evaluations to employees prior to allowing employees to wear a tight-fitting respirator with HEPA cartridges. This condition potentially exposed employees to medical hazards associated with wearing a respirator without first being cleared for pulmonary fitness by a medical provider.
