OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about June 3, 2015, at the Dollar Tree Store worksite located off Highway 18 & 55 in Blytheville, Arkansas, employee elevated in a personnel basket attached to the forks of a telescoping Terex Handler TH636C rough terrain forklift, did not wear fall protection while engaged in insulation and metal roof tasks.  This condition exposed employees to tip-over and falls from elevation.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval:    On or about June 3, 2015, at the Dollar Tree Store worksite located at Highway 18 & 55 in Blytheville, Arkansas, employee worked from an elevated personnel basket attached to the forks of a telescoping Terex Handler TH636C rough terrain forklift to perform insulation and metal roof tasks.  Manufacturer's approval was not obtained to ensure the personnel basket was compatible for use with the forklift.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 3, 2015, at the Dollar Tree Store worksite located off Highway 18 & 55 in Blytheville, Arkansas, the Davidson Pro portable ladder used to access and descend from the roof did not extend 3 feet above the landing surface.
