OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while standing in an elevated bucket of a skid steer loader, cutting tree limbs.   On 15 June 2015, an employee was inside the bucket attachment on a Bobcat Skid Steer Loader, S650, that was elevated at the time, cutting tree limbs with a hand-held Stihl chain saw, exposing the employee to a fall hazard of approximately 12 feet 8 inches to the ground below.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On 15 June 2015, an employee working on the ground without head protection was exposed to the hazard of being struck by falling tree limbs from above while another employee was cutting the limbs with a hand-held Stihl chain saw from an elevated bucket attachment on a Bobcat Skid Steer Loader.
