29 CFR 1910.1030(c)(1)(iv)(A): The review and update of the exposure control plan did not reflect changes in technology that elimnate or reduce exposure to bloodborne pathogens: On or about June 15, 2015, the employer failed to update their exposure control plan to reflect changes in technology that could eliminate or reduce employee exposure to Eligard which is a cancer treatment viscous medication as well is listed on the Highly Hazardous Chemical List as a carcinogen. Employees were using syringes to administer the Eligard to advanced stage prostate cancer patients that had no needle guard in place.

29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure: On or about June 15, 2015, the employer failed to document in their exposure control plan the consideration and implementation of safer medical devices for use by employees who administer Eligard which is a cancer treatment viscous medication as well is listed on the Highly Hazardous Chemical List as a carcinogen. Employees were using syringes to administer the Eligard to advanced stage prostate cancer patients that had no needle guard or cap in place.
