29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Production area- The extruder/trimmer machine operator was exposed to continuous noise at 119.2 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 91.3 dBA during the 469 minute sampling period on June 24, 2015. The exposure calculation included a zero increment for the 11 minutes not sampled. The employee had not received an audiogram or noise training. (b) Production area- The plastic container packer was exposed to continuous noise at 69.4 % of the permissible daily exposure of 85 dBA (8-hour time weighted average) or an equivalent sound level of 87.4 dBA during the 479 minute sampling period on June 24, 2015. The exposure calculation included a zero increment for the 1 minute not sampled. The employee had not received an audiogram or noise training. An effective hearing conservation program would include, initial baseline and annual audiograms, making hearing protectors available, and initial and annual noise training.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Production area- The employer had not established a written hazard communication program for employees exposed to hazardous substances such as, but not limited to, propylene glycol, propane, CRC Heavy Duty Degreaser containing perchloroethylene, and High density polyethylene plastic pellets (HDPE) which can emit carbon dioxide, carbon monoxide and small amounts of other organic vapors such as aldehydes and acrolein when heated.
