OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed crushing hazards while riding the bucket of an excavator to the bottom of a trench: Carl Bowers and Sons Construction worksite located at 524 Parkway St. Oshkosh, WI: On 6/17/15, the employer did not ensure employees were provided a safe means of egress to a trench excavation in that the pipe layer rode an excavator bucket into the trench which exposed him to crushing hazards. Among other methods, feasible and acceptable means of abatement include, but are not limited to: 1) Follow the Komatsu PC228 operator's manual which states "Do not allow people to ride the machine". 2) Follow the Association of Equipment Manufacturers (AEM) Safety Manual, which states on page 20 "Warning: Never use a bucket for a work platform of personnel carrier." 3) Follow the NIOSH Publication, Preventing Injuries When Working With Hydraulic Excavators and Backhoe Loaders, which states "Never permit workers to ride in or work from excavator or backhoe buckets."

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from falling excavator buckets: Carl Bowers and Sons Construction project site at 524 Parkway Ave, Oshkosh, WI: On 6/17/15, employees were exposed to struck by hazards from the bucket of an Komatsu 228 excavator that had not been checked for security to the quick connect coupler before continuing to dig near where other employees could be struck if the bucket fell off. Among other methods, feasible and acceptable means of abatement include, but are not limited to following the quick connect operator's manual instructions for testing the connection.
