29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides: a. On or about June 18, 2015, at the above addressed jobsite, an employee performing window cleaning operations from a pallet on the forks of a powered industrial vehicle (Pettibone 6036), approximately nineteen (19) feet above the ground, was exposed to injuries from falls due to the lack of guardrails.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a. On or about June 18, 2014, at the above addressed jobsite, an employee was operating a powered industrial vehicle (Pettibone 6036) during material handling operations. The operator of the powered industrial truck did not complete the required training and evaluation specified in paragraph (l).
