29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon black and particulates, not otherwise regulated listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentrations of 3.5 mg/m3 and 15 mg/m3 respectively: a. Carbon black concentration measured in the breathing zone of an employee applying electrospray coating in the paint booth was 12.76 mg/m3. This exposure exceeded the allowable 8-hour time-weighted average (8-Hr TWA) concentration of 3.5 mg/m3 by 3.6 times. The personal air monitoring consisted of a single filter sample collected over a 417 minute sampling period on 8/20/2015. The remaining un-sampled time of 63 minutes was included in the 8-Hr TWA as a zero exposure period. b. Total dust concentration measured in the breathing zone of an employee applying electrospray coating in the paint booth was 61.32 mg/m3. This exposure exceeded the allowable 8-hour time-weighted average (8-Hr TWA) concentration of 15 mg/m3 by 4 times. The personal air monitoring consisted of a single filter sample collected over a 417 minute sampling period on 8/20/2015. The remaining un-sampled time of 63 minutes was included in the 8-Hr TWA as a zero exposure period.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about June 10, 2015 and times prior to, employees applying electrospray coatings in the paint booth were working in visibly dusty conditions. No personal breathing zone sampling or other means had been used to evaluate whether the dust concentrations were above allowable limits or if any of the hazardous components of the dust, such as carbon black, exceeded allowable limits.
