29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard. On or before June 18, 2015, employees were exposed to fall hazards of greater than 10 feet when the employees a. climbed onto the 23" high wall at the edge of the pit in order to inspect the load in the trailer and push materials back into the trailer that were hanging over the sides of the trailer or would damage the tarp b. climbed onto the trailer in order to inspect and push materials back into the trailer that were hanging over the sides of the trailer or would damage the tarp In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

On or about June 18, 2015, an employee was taken to the hospital after a fall. The in-patient hospitalization was not reported to OSHA until June 22, 2015.
