29 CFR 1926.451(g)(4)(iv): Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface: (a) On or about June 24, 2015, the employer did not ensure employees hoisted in a basket attached to the forks of a JLG Model 6042 rough terrain forklift truck, were protected from fall hazards in that the front of the basket did not have a midrail installed between the top rail and the floor. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) On or about June 24, 2015, the forklift operator who lowered personnel who had been hoisted by a different operator to a height of greater than 21 feet in an basket attached to the forks of a JLG Model 6042 rough terrain forklift truck, had not been trained to operate the forklift truck. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
