29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) Dynamic 3PL - On or about July 06, 2015, employees (Full-time / Temporary) were required to operate powered industrial vehicles (PIVs) on a daily basis in the warehouse facility. The employer did not ensure that each operator had successfully completed the training required by paragraph (l), thereby exposing employees to struck-by hazards.

29 CFR 1910.178(n)(8): Under all travel conditions the truck shall be operated at a speed that will permit it to be brought to a stop in a safe manner. a) Dynamic 3PL - On or about July 06, 2015, employees (Full-time / Temporary) were allowed to operate powered industrial vehicles (PIVs) in the warehouse facility at excessive speeds. The employer failed to ensure that the PIVs were operated at a speed that permitted them to be brought to a stop in a safe manner. Employees were thereby exposed to the hazards associated with the PIVs being operated in an unsafe manner.
