29 CFR 1910.272(g)(1)(i): The employer did not issue a permit for entering bins, silos or tanks in the grain handling facility before the employees entered the bins, silos, or tanks to certify that the precautions contained in this paragraph (1910.272(g)) have been implemented prior to employees entering bins, silos or tanks:     a) On or about July 8, 2015, and at times prior, employees were exposed to engulfment hazards, fall hazards, and  unexpected startup of machinery when entering bins to unclog augers and performs other maintenance tasks. No permit had been issued to certify that the precautions listed in paragraph (g) had been implemented, including the following:    1. Deenergization and lockout/tagout of mechanical equipment;  2. Atmospheric testing for the presence of combustible gasses, vapors, toxic agents and oxygen content;  3. Fall protection;  4. Observer equipped to provide assistance;  5. Provide rescue equipment;  6. Observer trained in rescue procedures, including notification measures for additional assistance.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a)  On or about July 8, 2015, and at times prior, the employer had not established or implemented the elements of a written respirator program for employees that voluntarily wear respirators.  No medical evaluations had been performed and no training on the cleaning and storage of respirators had been provided.
