29 CFR 1910.178(o)(1): Only stable or safely arranged loads shall be handled. Caution shall be exercised when handling off-center loads which cannot be centered. WORKPLACE: The employer did not ensure through providing specific instructions and /or visual observation that the cured-in-place-pipe (CIPP) liner, on which employees were jumping up-and-down to force the CIPP into the sew line while being suspended by the forks of the JLG, Model G12-559 & Serial Number 500041385, Variable Reach rough terrain forklift truck was safely and positively secured on the forks. On or about July 8, 2015, the CIPP was displaced and fell off while two (2) employees were performing the above task, and one of employees sustained severe injuries from the incident.

29 CFR 1926.20(b)(2): Accident Prevention Responsibilities. It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. WORKPLACE: The employer did not ensure that a competent person conducted jobsite hazard assessment, including frequent and regular inspections of the worksite, materials and equipment prior to allowing employees to stand and jump up-and-down on the cured-in-place-pipe (CIPP) liner that was suspended by forks of JLG, Model G12-559 & Serial Number 5000413857, Variable Reach rough terrain forklift truck in order to attempt to force the liner into a sewer opening. On or about July 8, 2015, the CIPP was displaced and fell off from the forks while two (2) employees were performing the above task, and one of employees sustained severe injuries form the incident.
