29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports.  The employer does not ensure that each platform on all working levels of scaffolds is fully planked or decked between the front uprights and the guardrail supports.  This violation was observed on or about July 15, 2015, at the construction site when an employee was exposed to a 13 foot 2 inches fall hazard while doing masonry work from the second level of a scaffold without it being fully planked.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all working levels of scaffolds are fully planked or decked between the front uprights and the guardrail supports.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  The employer does not protect employees from falling when working on scaffold more than 10 feet above a lower level.  This violation was observed on or about July 15, 2015, at the construction site where an employee was exposed to a fall hazard when working on a tubular frame scaffold at approximately 13 feet 2 inches above the ground without being protected from falling to the ground.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees working from a scaffold 10 feet or more above a lower level are protected from falling.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   The employer does not ensure that employees have a ladder, stairway, or ramp to access a scaffold.  This violation occurred on or about July 15, 2015 at the construction site when an employee was exposed to a fall hazard while was accessing the second level of a scaffold that had no access ladder.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees have proper access to the scaffold platform.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed.  The employer does not ensure that portable ladders are used for the purpose in which they are designed. This violation occurred on or about July 15, 2105, at the construction site where an employee was exposed to a fall hazard when using an A-frame step ladder to gain access to the scaffold for which it was not designed.   Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.
