29 CFR 1910.146(k)(3)(ii): Whenever an authorized entrant entered a permit space to perform rescue services, a mechanical device was not available to retrieve personnel from vertical type permit space more than 5 feet: a) Worksite at 500 Lambson Lane, New Castle, DE 19720 - On or about July 10, 2015 and on prior dates, the employer failed to provide a mechanical retrieval device to be used for potential emergency situations requiring the hoisting of an incapacitated employee out from inside of a tank. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

This employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.134(c)(2)(ii), which was contained in OSHA inspection number 458633, citation number 1, item number 3a, and was affirmed as a final order on November 12, 2012, with respect to a workplace located at O.J. Food Grade Tank Truck Wash, Inc., 47-49 Old Lincoln Highway, Kearny, NJ 07032.
