OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a fall hazard:   On or about July 10, 2015, at the loading dock of Duty Free Air and Ship Supply LLC, Miami FL.  An employee was exposed to a fall hazard while working standing on a wood pallet lacking guardrails, which was not secured to the forks and/or mast of a powered industrial truck.

29 CFR 1910.178(m)(4): The employer did not prohibit arms or legs from being placed between the uprights of the mast or outside the running lines of the truck:  On or about July 10, 2015, at the loading dock of Duty Free Air and Ship Supply LLC, Miami FL.  An employee got his left hand index finger caught in between the mast of a forklift while standing on the loaded forks of a powered industrial truck.
