29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) The employer had not developed an energy control program for maintenance and servicing activities of equipment including, but not limited to, the Kaast Press Brake and the Omada F0-3015 Laser Cutting system. All provisions of 29 CFR 1910.147 (c) through (f) must be covered in an energy control program. Key elements include, but not limited to, the following: 1) Written energy control program. 2) Energy control procedures specific to each machine and equipment. 3) Providing isolating devices, i.e. locks, tags, chains, wedges, key blocks, or other devices to isolate equipment energy sources. 4) Periodic inspections to ensure procedures are being followed at least annually. 5) Train and communicate program with authorized and affected employees. 6) Application of control, preparation for shutdown, equipment shut down and verification. 7) Procedures for energy control involving more than one employee (group lockout). 8) Procedures to coordinate energy control procedures with outside contractors to ensure both parties understand and comply with the other's energy control program.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): a) On July 28, 2015, the Powder Coater was exposed to particulate not otherwise regulated 8 hour Time Weighted Average concentration of 22 mg/M3 during a sampling period of 448 minutes. The 22 mg/M3 8 hour Time Weighted Average concentration is 1.4 times the permissible 8 hour Time Weighted Average of 15 mg/M3. Feasible administrative or engineering controls include, but are not limited, the following: 1) Verify the powder coat dispensing system is expelling the correct amount of powder coat material. 2) Minimize the usage of cleaning methods, such as sweeping and using compressed air, that create dust clouds. 3) Utilize a vacuum system, approved for combustible dust, for gather excess powder coat material in the powder coat booth during color changes and clean up. 4) Utilize body positioning that minimizes the amount of time the employee between the parts being coated and the filters of the powder coating booth exhaust system. 5) Modify the powder coating booth to allow Powder Coater apply powder coat through a side opening which will keep the Powder Coater upwind during application.
