The employer failed to provide the employee with a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator. Use of tight fitting respirators without first conducting a medical evaluation exposes employees to the hazards of stressing of the cardiovascular systems and pulmonary systems which can lead to heart attack or stroke.

Allowing the respirators use by an employee with a beard exposes the employees to silica dust for which the mask is intended to protect them, in that, interference with the valves may cause the mask to not properly perform.
