29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. a) 2325 E Mansfield St. Bucyrus, OH, 44820: On or about Jul 22, 2015, Robinson Industrial Maintenance Company required the use of a tight fitting half face respirator during re-bricking operations. The employer failed to provide the employee with a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator. Use of tight fitting respirators without first conducting a medical evaluation exposes employees to the hazards of stressing of the cardiovascular systems and pulmonary systems which can lead to heart attack or stroke.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. a) 2325 E Mansfield St. Bucyrus, OH, 44820: On or about Jul 22, 2015, Robinson Industrial Maintenance Company failed to identify and evaluate the respiratory hazards of crystalline silica dust while employees were performing operations that involved the cutting and setting of bricks containing crystalline silica. Exposure to crystalline silica dust can cause silicosis.

The employer failed to ensure employees using a tight-fitting respirator passed a quantitative or qualitative fit test. Failure to complete a fit test exposes the employees to the silica for which the mask is intended to protect them from, in that, a mask that does not properly fit may not properly perform.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function. a) 2325 E Mansfield St. Bucyrus, OH, 44820: On or about July 22, 2015, Robinson Industrial Maintenance Company, allowed the use of a tight-fitting half face respirator to be worn by employee who had a beard. Allowing the respirators use by an employee with a beard exposes the employees to silica dust for which the mask is intended to protect them, in that, interference with the valves may cause the mask to not properly perform.
