29 CFR 1910.269(p)(4)(i): Mechanical equipment were not operated so that the minimum approach distances, established by the employer under paragraph (l)(3)(i) of this section, are maintained from exposed energized lines and equipment.   (However, the insulated portion of an aerial lift operated by a qualified employee in the lift is exempt from this requirement if the applicable minimum approach distance is maintained between the uninsulated portions of the aerial lift and exposed objects having a different electrical potential.)  An employee was exposed to burns due to contact with a 7.2 kV electrical power line while operating an Atlec Aerial Lift Model #FRY-82, Serial #0699CV0118 on a boom truck, and the minimum approach distances under paragraph (l)(3)(i) were not maintained.

29 CFR 1910.269(p)(4)(ii): A designated employee other than the equipment operator shall observe the approach distance to exposed lines and equipment and provide timely warnings before the minimum approach distance required by paragraph (p)(4)(i) of this section is reached, unless the employer can demonstrate that the operator can accurately determine that the minimum approach distance is being maintained.  On or about 7-15-15, the employer did not designate an employee to provide timely warnings before the minimum approach distance could be reached, and the operator was not able to maintain the minimum approach distance of 2 feet 1 inch.

29 CFR 1910.269(r)(1)(i): Before an employee climbs, enters, or works around any tree, a determination was not made of the nominal voltage of electric power lines posing a hazard to employees.     (However, a determination of the maximum nominal voltage to which an employee will be exposed may be made instead, if all lines are considered as energized at this maximum voltage.)    On 7-15-15, employees  were exposed to electrical shock while conducting tree trimming operations around 7.2 kV power lines and the employer did not ensure  a determination of the nominal voltage of the lines.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.  On 7-15-15, an employee was hospitalized due to burns received after contacting a 7.2 kV, and the employer did not report it to OSHA within twenty-four (24) hours.
