29 CFR 1926.1402(b):  The equipment was assembled or used without ensuring that ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer29 CFR 1926.1402(b): The equipment was assembled or used without ensuring that ground conditions are firm, drained, and graded to a sufficient extent so that, in conjunction (if necessary) with the use of supporting materials, the equipment manufacturer's specifications for adequate support and degree of level of the equipment are met.    a) Jobsite SR 11 and Salmon River, On or about 7/22/15: A LinkBelt Model HC108 was positioned and assembled with one of its outriggers setting upon a storm sewer grate. The Demolition Plan prepared by Barton and Loguidice shows the outriggers being placed upon the sidewalk and off of the area of the storm sewer grate.

29 CFR 1926.1412(f)(1): 29 CFR 1926.1412(f)(1): The equipment was not inspected at least every 12 months by a qualified person in accordance with paragraph (d) of this section.       a) SR 11, Malone, NY 12953. On or before 7/22/15: An employee was operating a Link Belt Model HC-108 Lattice type crane without having a annual inspection performed within the past twelve months. Section 3 of lattice boom was bent and deformed and cab contained broken glass.
