29 CFR 1926.55(a): Employees were exposed to material at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists: On July 27, 2015 from 1030 -1150 the employees were exposed to carbon monoxide during an 85 minute occupational exposure while working in a basement. The employees were using an electric jackhammer and a walk behind saw in order to remove the concrete flooring in the basement to add in an additional drain line. The employer failed to provide a safe and healthy work environment free of hazards associated with carbon monoxide (CO) levels: 1. A laborer was exposed to 394.0 parts per million (ppm) carbon monoxide level of air as determined by the employee's Carboxyhemoglobin (%COHb) which was 29.9% medical blood gas measurement following the employee's exposures to Carbon Monoxide. The 8 hour Time Weighted Average (TWA) exposure was 69.8 ppm CO (Sampling and Analytical Error SAE = 0.164), which is 1.40 times the OSHA PEL of 50 ppm CO. 2. A laborer was exposed to 372.7 parts per million (ppm) carbon monoxide level of air as determined by the employee's Carboxyhemoglobin (%COHb) which was 28.9% medical blood gas measurement following the employee's exposures to Carbon Monoxide. The 8 hour TWA exposure was 66.0 ppm CO (Sampling and Analytical Error SAE = 0.191), which is 1.32 times the OSHA PEL of 50 ppm CO. 3. A laborer was exposed to 360.2 parts per million (ppm) carbon monoxide level of air as determined by the employee's Carboxyhemoglobin (%COHb) which was 25.8% medical blood gas measurement following the employee's exposures to Carbon Monoxide. The 8 hour TWA exposure was 63.8 ppm CO (Sampling and Analytical Error SAE = 0.103), which is 1.28 times the OSHA PEL of 50 ppm CO.
