29 CFR 1910.1200(e)(1): Employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: (a) Jack Klun Trucking Inc, dba Klun Frac Sand Solutions Inc, at Well Pad SG 714-44, Parachute, CO: On and preceding 7/29/15, the employer had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. 29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d): (a) Jack Klun Trucking Inc, dba Klun Frac Sand Solutions Inc, at Well Pad SG 714-44, Parachute, CO: On and preceding 7/29/15, the employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d). Employees performed operations where they were exposed to inhalation and physical hazards, including but not limited to the following: (1) Exposure to respirable silica when using Preferred Pipeline Frac Sand Proppant 100 mesh (containing 40% crystalline quartz); (2) Exposure to respirable silica when using Imerys ProLite Proppant 40/70 mesh (containing 1% crystalline quartz); (3) Exposure to flying particles when working at the wellsite; and (4) Exposure to struck-by hazards when working around sand trucks.

29 CFR 1910.134(c)(1): The employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations: (a) Jack Klun Trucking Inc, dba Klun Frac Sand Solutions Inc, at Well Pad SG 714-44, Parachute, CO: On and preceding 7/29/15, the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix), in that employees were required to wear respirators during work operations. An employee engaged in hydraulic fracturing of oil and gas well used a gravity fed silo system for pushing fracking sand. The fracking sand consisted of either Preferred Pipeline Frac Sand Proppant 100 mesh (containing 40% crystalline quartz) or Imerys ProLite Proppant 40/70 mesh (containing 1% crystalline quartz). The transport and blending of the hydraulic fracturing materials released respirable silica and respirable dust. The employee was required to wear a North model 7700 half mask air purifying respirator. The employer did not have a written respiratory protection program. This condition potentially exposed the employee to a respiratory hazard.
