29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a.  On the site where employees were traveling from a aerial lift to the roof of the building, the employees were observed in the aerial lift not tied  off to the basket thereby exposing employees to a 40 foot fall hazard.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a.  On the lower roof where an employee was observed laying roof panel, fall protection was not provided thereby exposing employees to a 10 foot fall hazard.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  29 CFR 1926.502(d)(15)(i): as part of a complete personal fall arrest system which maintains a safety factor of at least two;   a.  On the roof of the hotel where employees were installing panels as part of a roofing system the employer did not provide a qualified person to supervise the installation of the fall protection system thereby exposing employees to a fall hazard.

On the upper roof where employees were installing metal panels for the roof, the employees were not trained in the requirements for fall protection training thereby exposing employees to a 40 foot fall hazard.
