29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) On or about July 28, 2015; fall protection: The General Contractor (Builder/Owner - John Eckenstaler) acting as the controlling employer failed to ensure an employee of (Filiberto Uribe) working from the first level balcony passing rafters to an employee on the second level was protected from falls of 11 feet 6 inches to the ground.    b) On or about July 28, 2015; fall protection: The General Contractor (Builder/Owner - John Eckenstaler) acting as the controlling employer failed to ensure an employee of (Filiberto Uribe) working from the second level joist assisting in the installation of the rafters was protected from falls of 19 feet 6 inches to the ground.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:    a) On or about July 28, 2015; fall from 6 foot step ladder: The General Contractor (Builder/Owner - John Eckenstaler) acting as the controlling employer failed to ensure an employee of (Filiberto Uribe) proper equipment was used during the installation of rafters at 530 Falling Water, Daphne, Al. 36526.  A six foot step ladder was used which required the employee to stand on the next to the top step in order to place and secure the top portion of the rafter at the roofs peak exposing him to falls of 19 feet 6 inches to the first floor decked surface.
