29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer. On or about July 27, 2015, employees were being exposed respiratory stressors while being required to wear respiratory protection such as, but not limited to, 3M full face tight-fitting respirators to perform routine work activities such as grinding and/or tuck-pointing. The employer did not implement an adequate written respiratory protection program that shall include information such as, but not limited to the following: a) Procedures for selecting respirators for use in the workplace. b) Medical evaluations of employees required to use respirators. c) Fit testing procedures for tight-fitting respirators. d) Procedures for regularly evaluating the effectiveness of the program. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(m)(2)(i): The employer shall establish a record of the qualitative and quantitative fit tests administered to an employee including: (A) The name or identification of the employee tested; (B) Type of fit test performed; (C) Specific make, model, style, and size of respirator tested; (D) Date of test; and (E) The pass/fail results for QLFTs or the fit factor and strip chart recording or other recording of the test results for QNFTs. On or about July 27, 2015, employees were being exposed respiratory stressors while being required to wear respiratory protection such as, but not limited to, 3M full face tight-fitting respirators to perform routine work activities such as grinding and/or tuck-pointing.
