OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   a)      Paint and Body Shop:  On or about August 6th, 2015 and at times prior to, the employer exposed employees to the hazards of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured.  Plastic pipe was used in above ground locations throughout the facility to transport compressed air from compressor through various diameter PVC lines at 95 psi.

The employee(s) had not had training on respirators to include Appendix D, were provided and wear filtering face piece respirators (dust masks).  No training was also conducted on required use of tight fitting particulate respirators provided by the employer.
