29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  (a) Jobsite - Employees were exposed to struck by hazards to include but not limited to cement, brick and tools located at the top edge of the excavation 10 feet above grade. Observed on or about 22 June 2015.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a) Jobsite - The employer did not perform inspections of the excavation or any part of the excavation with a competent person exposing the employees to cave-in hazards.  Noted on 22 JUNE 2015.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that they   (a) Jobsite -  Employees used a structural ramp located in between the excavation walls and steel concrete forms without shoring or other means of cave-in protection. Excavation site measured fifty (50) feet wide by fifty (50) feet long and ten 10 feet deep.  Observed on or about 22 June 2015.

29 CFR 1926.651(c)(1)(i): Structural ramps that were used solely by employees as a means of access or egress from excavations were not designed by a competent person.  (a) Jobsite - Employees were not provided with a safe means of access and/or egress to the work site. Graded soil ramp was not constructed, inspected or maintained by a competent person. Ramp constructed of loose spoil at the pitch of approximately 29 degrees to 38.30 degrees. Observed on or about 22 June 2015.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement.  (a)  Jobsite - Employees preforming concrete foundation casting were exposed to protruding un-capped rebar at the height of 10 feet and ground level. Observed on or about 22 June 2015.
