29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section: a. The employer has failed to submit abatement certification within ten days of the abatement date, September 17, 2015, for a violation of 29 CFR 1926.1053(b)(9) or in the alternative: 29 CFR 1926.1053(b)(4), issued as citation 1, item 2, and described as follows: The employees were observed using a ladder hoist system on a ladder which they were also using for access. The ladder hoist caused for a break in elevation of 3.5 feet due to the ladder hoist blocking the bottom of the ladder, thereby exposing employees to a fall hazard.

The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 17, 2015, for a violation of 29 CFR 1926.501(b)(13) issued as citation 1, item 1, and described as follows: The employees were observed installing shingles on the roof of a multilevel home without fall protection, thereby exposing employees to a fall hazard of 22 feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. The employees were observed installing shingles on the roof of a multilevel home without fall protection, thereby exposing employees to a fall hazard of 22 feet.
