29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:   On or about August 4, 2015, during the installation of roofing material at 4125 Medina Rd, Akron, Ohio 44333; the employer did not conduct frequent and regular inspections of the job site where employees were exposed to fall hazards from heights approximately 32 feet.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   On or about August 4, 2015, at the job site located at 4125 Medina Rd, Akron, Ohio 44333 during the installation of roofing material on a low slope roof, the employer did not ensure employees were adequately trained or retained information in regard to fall hazards and the implementation of a fall protection system.  The Legacy Roofing Services, Llc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(c)(3) training Requirements, which was contained in OSHA inspection number 942844, citation number 1, item number 3 and was affirmed as a final order on 2/7/2014, with respect to a workplace located at 6255 Halle Drive, Valley View, Ohio 44125.
